ART THIEVERY:

It must not be prevented, it must be punished!

"Preventing" art thievery is a foolish endeavour:

1)Watermarks ruin images

2)Disabling right clicking makes wallpaper lovers cry

3)You're cheating yourself out of POTENTIAL INCOME!
It's incredibly EASY to win cases of "artist vs art thieves" if they're in 1st world countries and if they've made profit off your art.
In most cases the artists win settlements in thousands of dollars without EVER going to court.

COMMANDMENTS:
1)I will not "prevent" art thievery
2)I will laugh at art thieves, not be angry/afraid of them
3)I will fight art thieves, win money and buy cake.

COPYRIGHT INFRINGEMENT LETTER

This letter is your MAIN WEAPON against ART THEFT!

If anyone ever steals YOUR work, this is what you write to the thieves, be they an individual/magazine/website/newspaper/music band/etc.
Simply fill in the blanks and erase the stuff in the brackets.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
To: __________________(art thief's name/company)
It has come to my attention that you have made an unauthorized use of my copyrighted Work entitled "____________ (name of stolen artwork)" in the publishing of a ___________(your website/advert/newspaper/magazine)
I have reserved all rights in the Work, which was first published on _______________ (date) at _______________(my website link), with copyright registered to me.
The advert which appears in your __________ (website/magazine), is essentially identical to the Work and clearly used the Work as its basis.
You neither asked for nor received permission to use the Work as the basis for the advert, nor to make or distribute copies of it. Therefore, I believe you have willfully infringed my rights under 17 USC Section 101, et seq. and could be liable for statutory damages as high as $100,000.
Under the copyright law I demand:
Compensation and Immediately cease the use and distribution of all infringing works derived from the Work, and all copies of it, and that you deliver to me all unused, undistributed copies of it, or destroy such copies immediately, and that you desist from this or any other infringement of my rights in the future.
Also, I demand a compensation for the use of the image.
Your company did not notify me, we did not sign any contracts, and I have not been paid for the use of my work.
If I have not received an affirmative response from you in two weeks, indicating that you are ready to discuss terms of payment for the use of my work and comply with my requirements, I shall consider taking the full legal remedies available to rectify this situation.
Sincerely,
DISCLAIMER:
Please be "polite" to the art thieves, even if you know they've taken stuff. Do NOT flame. Do NOT act like a mindless, angry, hate-mob.
Flaming will get you kicked from this group. We are not a mob, we are an organized machine to help artists fight art theft.
Some art thieves simply don't bother to read DA upload rules or know nothing of copyright law.
Fight art theft with the power of LOVE, LAW, and LOGIC.
1-inform the violator of the rules they're breaking, in a polite manner, like this for example:
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

Dear {{__________}},
Please note that the image/deviation you have in your gallery is a copy/unlicensed edit of {{__________}} and is therefore a copyright violation. Because deviantart automatically writes "artwork (C) you" this means that you are taking the original artist's image rights, without permission.
DeviantART policies on copyright violation are FAQ #8: What are violations of the deviantART copyright policy?.

I'm sure that the original artist would appreciate it if you credited for their hard work/asked their permission on whether you are allowed to use/repost their work.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
2-Report the deviation using the "report violation" button, ONLY if you're the first person to catch the thief.
3-if you suspect that the art thief has a ton of violations, send a report to this group in the form of a NOTE
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

ALL COMMENTS ABOUT "SUSPECTED" ART THIEVES WILL BE HIDDEN.
(per request of DA administration)
PLEASE REPORT ART THIEVES IN THE FORM OF A NOTE TO THE GROUP!

I have another question. what do you do when you suspect someone is an art thief that you caught before, and now they're using a few other accounts, but they're not actually stealing? like a lot of their characteristics match up to the art thief, and their behavior is suspicious, like when they recolor a vector but they say they used a base? I don't want to accuse someone of being the thief that I had to deal with, but I have reason to believe that this one account is the same person. what should I do?

I'd say still report them to us. We'll keep an eye on them and make sure their behaviour doesn't cross further into art thievery territory.

I'd say to avoid unnecessary drama by leaving them alone. If they are stealing, just report them to us. You don't want to accuse them of being a different thief unless you have some solid evidence.

I have a question. every time I try to report an art thief to DA, they send me a message like this:

Thank you for contacting us, Reitanna-Seishin.

Copyright infringement is a serious matter and our Copyright Policy appears as a link at the bottom of most pages on DeviantArt.com.

We accept copyright claims only from the copyright owner of the original work, typically the artist responsible for the original work that you feel may have been copied or adapted by another deviant. The original artist has the opportunity to file a "DMCA Takedown Notice" which we will then review.

We cannot act on copyright claims made by people who are not the copyright owner, however well intentioned. This is because in many cases the copyright owner does not want to enforce their copyright in the particular circumstances that are involved or the person making the copy may have permission.

You may wish to contact the original artist on your own, inform him or her about the Copyright Policy and point them to the process of filing a DMCA Takedown Notice. These are the two links you may wish to use in you note:
about.deviantart.com/policy/co…
help.deviantart.com/dmca

We hope you found this answer helpful and thank you for your concern and willingness to call this matter to our attention. We value your membership and participation in DeviantArt.

I understand the point of the DMCA takedown notice, but does this mean that when we report the thief, DA's not doing anything about it because we're not the original copyright owners? I think this is a HUGE problem, because sometimes we can't always contact the original artist due to the art being taken from a different web site. to me it feels like DA doesn't care, because if they did, they'd look into the reports. what is your opinion on this? and how do you guys fit into the whole bringing down art thieves scene? do you have to report them the same way we do? do you get the same messages?

Well at first we will try talking to the person who was suspected of theft, We talk to them first and if it came down to it we would report them. I haven't had any of my other co-workers getting messages like that but i am sure they get them, unfortunately D.A does not care, we do and we try the best of our ability to help out when needed, sadly though it feels were wasting our time,

1.) They do not take the art down, start fights and is hateful
2.) It does work and they corporate with ease. (but it's a rare occasion.)

It is indeed a huge problem when D.A does not do anything with Sexual harassment, cyber bullying and especially art theft. I mean it is an Art website, suppose to be for those with good intentions and great abilities/skills. I have seen D.A go to shit lately, allowing porn on the site especially and when me and others say it is not art and report it blind horn dogs attack us with no reason what so ever, just want to fap to them. Sad to be so blunt about it but it is true and they do do it.
I have had people try to report stolen art or file for harassment/bullying in hopes of D.A's help and assistance, only to be turned down or worse BANNED. I am beyond upset with D.A nowadays, no one gets justice anymore. Which is why i don't really put art on this site, only my videos and staying in touch with friends and family. But if there was any way chance to have new Administrators that actually care for the art community and the safety of others on the internet, i would vote for that. And when you try to report art theft it doesn't always work unless the real owner of the work tells them about it, which i think is BS because ANYONE should be able to pitch in and help the creator out, and not have to stand by and watch it go down. We should be able to have the power to help them and protect their stuff from being degraded by filthy sticky hands. Most of the time our art theft reports involve Trolls and bullies, which is where number 1 comes in. It's tiresome and I wish i was making a bigger difference in this community art site, but D.A won't have it, it's like you trying to report a crime on the streets and the cops normally don't show.

It's really sad to see such good art and people being brought down because D.A is not doing what they are suppose to be doing, and that right there proves that this is not only an art site, it's where more sick people come to make others life's hell, just like Facebook and other sites. Yu just cannot be safe anymore, It makes me more then sick, it boils me with anger. I hope this answer cleared a few things, Sad to say that we can't do much on Doombringers and other art groups to help with the stuff that D.A staff and Administrators won't do.
But we try very hard to make at least a little difference better trying then not.

you pretty much confirmed all of my suspicions. I was outright told by an admin that I would be suspended from the help desk if I kept asking questions. it is frustrating, and it makes me want to leave the site, but all my friends and fans are here. it's upsetting because I want to help people, I want to help ban art thieves of all kinds, not just the ones that steal from ME. in fact, that seems a little selfish, only ratting on people that stole MY work and not other people's. I tried asking the admin how we're supposed to alert the original artist if the original is now on DA, and they closed my ticket, telling me that if I keep "spamming" them, they'll suspend me. I took a screenshot of it. reitanna-seishin.deviantart.co…

damphyr? Don't expect any help from her, she's won't do nothing when you have a problem, she's only here to make a commercial of herself. She told me how she will suspended me too if I keep reporting Rule34 by via helpdesk when it get's flagged as invalid. I rub her on her nose a pedo who is turning his sick stuffs into gore pic. He posted pictures of children torn it apart. When we report it to be taken down, she refuse to do that by flagging our report as spam.

Wow my god. That is terrible, that is exactly what i mean, and i just can't bring myself to even consider them "help desk"
I know for dang sure that ain't no bot either. Goddamned bastards i tell ya' always thinking of themselves in power nothin' more..I am really sorry they are doing that i wish my team could do more then them, i know i would not mind pulling weight around if i was D.A staff/administrator/Help desk. I would for sure do something about that, even if they cannot help with those whose art has been stolen outside of D.A does it not hurt to just make a help desk or somethin' on that site as well? Or making a site where if an art has been reported stolen and put on D.A find the source on where that work was taken and make an Administrator to deal with it.
